Supreme Court News: Relief To Delhi Government, Supreme Court Ready To Hear Against Central Ordinance

 

The Delhi government’s fight against the central government’s ordinance brought to control the administrators in Delhi has reached the Supreme Court. The Supreme Court has agreed to hear the petition of the Delhi government.

The Supreme Court will hear Delhi government’s plea against the central ordinance on July 10. Soon after the ordinance was promulgated, the Delhi government had said that it would go to the Supreme Court against it.

Under the ordinance of the central government, the lieutenant governor has been given the right to take the final decision related to the transfer and posting of officers in Delhi. Under the National Capital Territory of Delhi (Amendment) Ordinance, 2023, a National Capital Public Service Authority will be constituted for transfer and disciplinary action against Group A officers of DANICS cadre serving in Delhi.

Authority constituted under the Ordinance

There will be three members of this authority. In which the Chief Minister of Delhi, Chief Secretary of Delhi, Home Principal Secretary of Delhi will be there. The Chief Minister of Delhi has been made the chairman of this authority. Explain that the officers of Delhi, Andaman-Nicobar, Lakshadweep, Daman and Diu, Dadra and Nagar Haveli Civil Services are included in the DANICS cadre. However, the final decision of transfer and posting of officers will be of the Lieutenant Governor.

The AAP government in Delhi has been alleging that the central government is not allowing it to function through the LG. The AAP government had moved the Supreme Court against it. Where the Supreme Court gave a decision in favor of the Delhi government on May 11 and made it clear that only the Delhi government can transfer and post the bureaucrats of Delhi. The Aam Aadmi Party had declared the Supreme Court’s decision as their victory, but their happiness did not last long as the central government brought the National Capital Territory of Delhi (Amendment) Ordinance, 2023.
