Nadeem Ansari Who Allegedly Posted Beheading Video On Social Media Granted Bail

Nadeem Ansari, the man who is languishing in jail since 13.06.2022 for allegedly posting multimedia content regarding Nupur Sharma on social media, has been granted bail by Allahabad High Court.

Allegations against the accused is that he posted video on social media (regarding beheading of Nupur Sharma) to incite communal tension. He was charged under Sections 153 A, 295 A, 505 (2) I.P.C. and Section 67 of Information Technology Act, 2008 (P.S. Khanpur, District Bulandshahr, during pendency of trial).

The Learned Counsel on behalf of applicant-accused argued that applicant is innocent and has been falsely implicated in the case.

What is Section 67 of Information Technology Act, 2000? Punishment for publishing or transmitting obscene material in electronic form. -Whoever publishes or transmits or causes to be published or transmitted in the electronic form, any material which is lascivious or appeals to the prurient interest or if its effect is such as to tend to deprave and corrupt persons who are likely, having regard to all relevant circumstances, to read, see or hear the matter contained or embodied in it, shall be punished on first conviction with imprisonment of either description for a term which may extend to three years and with fine which may extend to five lakh rupees and in the event of second or subsequent conviction with imprisonment of either description for a term which may extend to five years and also with fine which may extend to ten lakh rupees

However, the bail was opposed by learned AGA.

The Hon’ble High Court observed that, “Considering the entire facts and circumstances of the case, submissions of learned counsel for the parties and keeping in view the nature of offence, evidence, complicity of accused and without expressing any opinion on the merits of the case and larger mandate on the Article 21 of the Constitution of India, laid in Satendra Kumar Antil Vs. C.B.I. & Another, passed in S.L.P.(Crl.) No. 5191 of 2021, the Court is of the view that the applicant has made out a case for bail. The bail application “is allowed.
