Allahabad High Court News: “Court Is Against Illegal Relations Not Live-in Relationships 

 

Allahabad High Court has said in one of its important decisions that we are not against live-in-relationship, but against illegal relationship. The High Court, while hearing a petition filed by a married woman and her lover, said that illegal relations cannot be given police protection at the cost of social fabric.

The court observed that giving protection to the person having an illegal relationship means giving recognition to the illegal live-in relationship. The Hon’ble court dismissed the petition filed by the married wife Yachi, living in a live-in relationship with another man, demanding security from her husband on the apprehension of a security threat.

This order has been given by Justice Renu Aggarwal on the petition of Prayagraj’s Sunita and others. It was argued on behalf of the petitioner that she is a 37 year old adult woman. She is voluntarily and peacefully living in live-in with the second petitioner since January 6, 2015 due to the tortuous behavior of her husband.

The husband is trying to endanger her peaceful life. He should be provided security. There is no criminal case against both of them, nor is there any case registered in this matter. It was said on behalf of the government that the petitioner is living in an illegal live-in with a man. He is married, not divorced.

The court has earlier also refused to give security in such a case. The court said that protection cannot be given because tomorrow the petitioners can say that the court has accepted their illegal relationship. Directing the police to give them security will indirectly be considered as our consent to such illegal relations. Divorce is already included in the sanctity of marriage. If the petitioner has any differences with her husband, then she will have to first proceed for separation from her husband or wife as per applicable law. The wife cannot be allowed to live in an illegal relationship with another man while the husband is alive.
