UKSSSC Paper Leak: The High Court stayed the order banning the candidates for five years
The High Court has stayed the order banning two candidates of Udham Singh Nagar in the competition/examination listed for the commission as well as other services under the state government for the next five years in connection with the question paper leak in the secretariat recruitment examination of the Uttarakhand Subordinate Services Selection Commission.
The court has asked the state government and the Subordinate Services Selection Commission to file their reply within three weeks. On Friday, a hearing was held on the petition of Daya Ram and Ajay of Udham Singh Nagar in the single bench of Justice Ravindra Maithani.
Petitioner’s advocate Sanjay Bhatt told the court that on May 16, the Commission’s Secretary Surendra Singh Rawat had issued an order banning both the candidates for competitive examination for the next five years.
On behalf of the Commission, under Section-9/10 of the Uttar Pradesh Public Examination (Prohibition of Unfair Means) Act-1998 and other relevant sections, he was held guilty of using unfair means to break the integrity of the examination.
Notice was issued to these candidates on 24 April 2023 by the Commission, but satisfactory reply was not given. According to the counsel for the petitioner, according to the Act, this order can be passed only by the judicial magistrate after the trial, the commission has no right. After which the single bench has stayed the order of the commission.
