Eminent Citizens Wrote President Droupadi Murmu Against Legalization of Same-Sex Marriage
Around 120 eminent citizens consisting retired high court judges, ex-bureaucrats and other wrote to the President of India against the legalization of same-sex marriage. The letter termed it “highly objectionable” and against the cultural ethos of the country.
It is further said that legalization is essentially legislative function and the issue has to be dealt by legislature, not judiciary.
The Signatories of the letter are former Comptroller and Auditor General (CAG) Rajiv Mehrishi, former home secretary L C Goyal, former foreign secretary Shashank, former RAW chief Sanjeev Tripathi, Justice (retired) S N Dhingra and Justice (retired) Lok Pal Singh among others.
The letter mentioned that “If they are allowed to adopt children, they can’t maintain stable and long-lasting relationships with their families, parents, relatives and partners. The health and future of such children will be severely compromised.”
Earlier, Bar Council of India (BCI) echoed the same views. However, Supreme Court Bar Association in its resolution dated 27.04.2023 denounced the stand taken by BCI saying that it was highly inappropriate of Bar Council of India” to oppose the hearing. The Resolutions mentions that, “it is the duty of the Court to hear the petition and decide whether should be adjudicated by the Court or left to the wisdom of Parliament.”
It should also be noted that, earlier Hon’ble Supreme Court remarked that recognizing the same-sex marriage is up to the legislature.
