Sushil Kumar Modi Files Petition Before Patna High Court For Failing to Appear In Defamation Case

Sushil Kumar Modi, a member of the Rajya Sabha and leader of the BJP, submitted a petition on Wednesday to the Patna High Court in an effort to obtain an arrest warrant for Congress leader Rahul Gandhi for failing to appear before a Patna court in a defamation case in 2019.

After Gandhi failed to appear before the MP/MLA court in Patna in the defamation case Modi had filed against Gandhi for his remark that “all thieves have Modi surname,” the MP moved the High Court.

A local court in the Surat district of Gujarat had previously found Congress MP Rahul Gandhi guilty of defamation on March 23.

According to a 2013 Supreme Court order, Gandhi was removed from the Parliament following his conviction under Sections 499 and 500 of the Indian Penal Code (IPC), both of which carry a maximum sentence of two years.
