A vacation bench of Justices Aniruddha Bose and Rajesh Bindal asked Singh’s counsel Ajesh Kumar Chawla to explain the reason for the delay in filing the appeal. Chawla admitted that there was a delay of 10 years in filing the appeal against the High Court order, but it was not done intentionally. He said, since Vijender Singh was living at a different address from the one recorded in the court records, he was not aware of the order of the High Court.

The High Court on 30 January 2013 upheld his conviction and reduced the jail term to six months. Vijender, who was released on bail for almost four decades, surrendered on 20 April 2023 and deposited a fine of Rs 2000. Vijender has then moved the Supreme Court seeking quashing of the conviction and sentence.

Virendra Singh, a resident of Uttar Pradesh, was caught selling adulterated milk on October 7, 1981. The latter was convicted by a trial court on September 29, 1984. He was sentenced to one year’s rigorous imprisonment and fined Rs 2,000 by the trial court under the provisions of the Prevention of Food Adulteration Act, 1954.

After this, Virender Singh challenged the order of the trial court in the Bulandshahr sessions court. After a trial lasting three years, the sessions court on July 14, 1987 confirmed the trial court’s order and upheld his conviction and sentence. When Virendra Singh did not get relief from the sessions court, he moved the Allahabad High Court on July 28, 1987.

After several hearings, the court passed an order on January 30, 2013, upholding his conviction, but reducing the sentence to six months’ rigorous imprisonment and a fine of Rs 2,000. After this, Virender Singh who was still on bail, surrendered before the trial court on April 20, 2023. Also deposited a fine of Rs 2,000 more than a decade after the High Court order. After this he was arrested and sent to jail.
